A Nebraska couple, Kevin Fair and Terry Fair, lost their home due to unpaid property taxes totaling $588. After being unable to pay the amount required to redeem their property, Continental Resources obtained a tax deed. Fair claimed that losing property worth $59,759 for such a small tax debt constituted an unconstitutional taking. The Nebraska Supreme Court ruled Fair had a valid takings claim based on property value.
