Justice Sunil Beniwal made the observation while dismissing a petition filed by a woman seeking to quash cheque dishonour proceedings initiated against her by a finance company. The woman had issued a cheque for Rs 2.10 lakh in connection with loans taken by her husband. The Court examined whether proceedings under Section 138 of the NI Act could continue against a guarantor whose own cheque had been dishonoured.
